These Terms & Conditions ("Terms") govern your use of this website, Cutting Edge Cutting Tools, operated by Dixie Tool Company ("Dixie Tool", "we", "us", or "our"), and any order you place with us through it. By using this website, creating an account, or placing an order, you agree to these Terms. If you do not agree, please do not use the website.
About Dixie Tool Company
Since 1972, Dixie Tool Company has supplied industrial tooling from our locations in Brownsville and Austin, Texas. We are an authorized distributor of the brands we carry, including Harvey Tool, Micro 100, Titan USA, and Helical. We are not the manufacturer of the products sold on this website. Our Cutting Edge Cutting Tools website is owned and operated by Dixie Tool Company, and orders placed on it are sold and fulfilled by Dixie Tool Company.
1. Eligibility and Accounts
- You must be at least 18 years old, or the age of majority where you live, to place an order.
- If you order on behalf of a company, you confirm you are authorized to bind that company to these Terms.
- You are responsible for keeping your account login confidential and for all activity under your account. Tell us right away if you believe your account has been used without your permission.
- We may refuse service, suspend, or close an account at our discretion, including for suspected fraud or misuse.
2. Products, Descriptions, and Pricing
- We make every effort to show products, specifications, dimensions, and images accurately. Much of this information comes from the manufacturers, and we do not guarantee that every description, image, or specification is complete, current, or error-free. Product images may be representative of a product family rather than the exact item.
- Prices are shown in U.S. dollars and may change without notice. Some items are sold by the case or package, as noted on the product page.
- If a product is listed at an incorrect price or with incorrect information, we may cancel any order for that product, even after it has been confirmed. If you have already been charged, we will refund you in full.
- Manufacturers may change product specifications, packaging, part numbers, or pricing, or discontinue products, without notice to us. Where a manufacturer supplies an updated or equivalent version of a product, we may ship that version.
- All products are subject to availability. We may limit or cancel quantities ordered.
3. Orders and Acceptance
Your order is an offer to buy. Receiving an order confirmation email does not mean we have accepted your order. We accept your order when we ship it. We may decline or cancel any order, in whole or in part, for any reason, including stock availability, pricing or description errors, or suspected fraud. If we cancel an order you have paid for, we will refund the payment.
4. Payment
- We accept the payment methods shown at checkout. Card payments are processed by third-party payment processors; we do not store your full card number.
- Net Terms: Net Terms are available only to customers with an approved credit account. We may require a credit application and references before approving an account. Invoices on Net Terms are due according to the terms of your approved account. Purchase order (PO) numbers can be entered in the Order Comments field at checkout. We may suspend Net Terms for past-due accounts.
- You agree to pay all applicable sales and use taxes. Tax-exempt customers, including buyers purchasing for resale, must provide a valid exemption or resale certificate before the order is placed for tax to be removed.
5. Shipping and Delivery
- We ship to addresses within the contiguous United States unless otherwise arranged with us.
- As a distributor, we may ship your order from our own warehouse or directly from the manufacturer or one of its distribution centers. An order may arrive in more than one shipment.
- Shipping times shown on the website are estimates, not guarantees. We are not responsible for delays caused by carriers, manufacturer lead times or backorders, weather, or other events outside our control.
- Risk of loss passes to you when the order is delivered to the carrier. Please inspect your shipment when it arrives and report any damaged, missing, or incorrect items to us promptly.
6. Returns and Refunds
Returns are handled under our Return Policy, which is part of these Terms. In summary:
- Returns are accepted within 30 days of delivery.
- If you receive the wrong item, or an item that is defective or damaged, we will issue a full refund or send a replacement.
- Items returned for any other reason are subject to a 20% restocking fee, and must be unused and in the original, undamaged manufacturer packaging.
- Items that have been used, altered, or damaged by the end user will not be accepted for a refund.
7. Product Use and Safety
Our products are intended for professional and industrial use. Many of them, including cutting tools, abrasives, and industrial equipment, can cause serious injury if used improperly. You are responsible for choosing the right product for your application, for following the manufacturer's instructions, speeds, feeds, and safety guidelines, and for using appropriate personal protective equipment. Technical information or recommendations we provide are offered as a courtesy and do not replace your own judgment or the manufacturer's guidance.
8. Warranties
Products are covered only by the warranty, if any, provided by their manufacturer. We will help you pursue a manufacturer warranty claim where we can. Except for that manufacturer warranty and as required by law, products and this website are provided "as is", and Dixie Tool Company disclaims all other warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the fullest extent permitted by law, Dixie Tool Company will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost production, or downtime, arising from your use of this website or any product you buy from us. Our total liability for any claim relating to an order will not exceed the amount you paid for the product that is the subject of the claim.
10. Website Content and Intellectual Property
The content of this website, including text, graphics, logos, and images, belongs to Dixie Tool Company or its suppliers and is protected by law. Manufacturer names, brand names, logos, and trademarks shown on this website belong to their respective owners and are used to identify the products we distribute. You may use the website to browse and buy products for yourself or your company. You may not copy, scrape, resell, or republish its content without our written permission.
11. Acceptable Use
You agree not to misuse the website, including by attempting to gain unauthorized access, interfering with its operation, placing fraudulent orders, or using automated tools to collect data from it.
12. Export Compliance
Products sold on this website may be subject to United States export control and sanctions laws. If you export, re-export, or transfer products outside the United States, you are responsible for complying with those laws, including obtaining any required licenses.
